Construction Defect Litigation 

Fireman’s Fund Insurance Company v. Perry Electric, Inc.

Circuit Court of Hillsborough County, Florida 2020.

Successfully recovered $3.8 million, within six months of filing suit when a complex electrical fire was caused by the defective work of an electrical contractor. The fire never escaped the building’s concrete electrical room so fire damage was limited. The vast majority of the loss was due to smoke and water damage to surrounding areas.

Immediate notification of potentially responsible parties and a joint inspection of the scene were important in eliminating defense arguments that other parties were responsible for the loss. Excellent work by the insurance carrier’s team in thoroughly documenting the claim was critical to proving damages and convincing the responsible party that continued litigation would be unsuccessful.

 

Great Northern Insurance Co. v. Southeastern Insulation, et al.

U.S. District Court, Middle District of Georgia, December 2009

Successfully represented homeowners and their insurer against multiple contractors following a fire loss causing $1 million in damages.  The matter was confidentially resolved four months prior to trial in a manner very favorable to the clients.

Trial victory in a construction defect matter on behalf of Allstate Insurance in a matter assigned two weeks prior to trial.

 

Woodlake Construction, LLC v. Weems

Superior Court of Putnam County, Georgia

Jury Trial, May 2002

Trial victory in the representation of a general contractor in defense of fraud, breach of contract, and negligence claims related to the construction of a $600,000 dollar home.  The jury denied the plaintiff’s claims and awarded my client $90,000 for lost profits and attorney's fees.

 

Gray Communications, Inc. v. Law Engineering, Inc. et al.

Circuit Court of Knox County, Tennessee

August 2001

Represented a Knoxville television station against an engineering firm, the general contractor, and grading subcontractor in a matter resulting from foundation settlement of a recently constructed television station, causing extensive damage and costly repair work.  The matter was favorably settled shortly before trial.

 

R & L Carriers, Inc. v. Jasper Grading, Inc.

Superior Court of DeKalb County

February 2000

Successfully defended the general contractor in a suit alleging defective grading and paving work at a truck terminal facility, where owner alleged over $2 million in damages.  The matter was confidentially settled in a manner very favorable to the client.

Products Liability

Federal Insurance Co. v. General Electric

U.S. District Court, Southern District of Mississippi, December 2009

Successfully represented Forrest County General Hospital and its insurer in a $1.4 million dollar dispute regarding the failure of a General Electric MRI machine.  After defeating defense motion for summary judgment, the matter was favorably resolved two weeks prior to trial.

 

Sterilization Services of Virginia, Inc., et al. v. Anguil Environmental Systems, Inc.

Circuit Court of Cook County, Illinois

January 2000

Represented Plaintiff whose gas sterilization facility exploded, causing $12 million in damages, following the malfunction of a catalytic oxidizer system used to treat ethylene oxide gas.  After extensive litigation, in which the manufacturer vigorously asserted that its product was not defective, obtained a policy limits settlement on behalf of the client.

 

Chemical Process Failure

T-2 Labs Explosion

Jacksonville, Florida - 2008

Represented multiple insurers to recover claims paid as a result of significant property damage following the December 2007 explosion at T2 Labs in Jacksonville, Florida.  The explosion was reported to be the largest civilian chemical explosion in United States history. Retained experts and participated in evidence retention and initial investigation with U.S. Chemical Safety Board representatives.

 

Manufacturing Process Failure

Imperial Sugar Refinery Explosion

Savannah, Georgia - 2008

Representation of major insurance carriers which provided coverage for the Imperial Sugar refinery in Savannah, Georgia, following a catastrophic 2008 explosion which destroyed the facility.  Analyzed potential subrogation opportunities and coordinated investigation with representatives of the insured, the U.S. Chemical Safety Board, and OSHA.

 

Business Ownership Dispute

Terry v. United Tower Company

Jury Trial, August 2002

Trial victory in a complex partnership dispute involving winding up partnership and distribution of business assets.  Defeated plaintiff’s claim for $1.3 million dollars in damages.

Contractual Dispute Following Sale of Business Assets

Therm Acquisition, Inc. v. Vista 2000, Inc. et al.

U.S. District Court, Western District of Michigan

Jury Trial, Grand Rapids, Michigan, February 2001

Successfully defended a publicly traded client against allegations of fraudulent misrepresentation and breach of a $12 million dollar asset purchase agreement.  Obtained summary judgment on all claims before the trial court. The Sixth Circuit Court of Appeals subsequently held that a factual dispute necessitated a jury trial on one issue.  Successfully tried the matter in which the jury denied Plaintiff's claim and awarded our client the principal and interest balance on an outstanding promissory note.

 

Commercial Dispute Regarding Shipping Terms

Government Technology Services Inc. v. Bestway Express, Inc., et al.

U.S. District Court, Eastern District of Virginia

April 2000

Obtained a favorable settlement for Plaintiff, the evening before trial, in an action against common carriers involving the loss of $365,000 in computer equipment.
